INSTANT DELIVERY SERVICE

TERMS AND CONDITIONS

1. "Instant Delivery" service (the "Service") is an intra-city delivery service that allows Customers to create an order for parcel collection from the Sender's address and delivery to the Recipient's address within the same province/city (*), to meet Customers' delivery needs with shortened delivery times. The Service includes:
  • Collection of the parcel from the Sender's address;
  • Delivery of the parcel to the Recipient's address within the applicable service area; and
  • Order status tracking throughout the delivery process.
The Service is only available for orders that satisfy the applicable service eligibility requirements at the time the order is created. SPX reserves the right to adjust the service coverage, eligibility criteria, and service availability based on its actual operational capacity.
(*) For clarification, "within the same province/city" shall be determined based on the administrative boundaries in effect prior to 1 July 2025, until further notice or adjustment is announced by SPX.

2. Service Fees and Payment

  • The fees stated above are the base fares applicable to the Instant Delivery Service.
  • Depending on objective circumstances (including but not limited to weather conditions or epidemics), the service area, service time, and the service capacity of SPX's delivery partners, SPX may adjust the applicable service fee upward or downward as appropriate. However, any surcharge shall not exceed the following limits based on the base fare:
  • Weekday peak hours: up to 50% of the base fare;
  • Adverse weather conditions: up to 100% of the base fare;
  • Public holidays and Tet holidays as prescribed under applicable labor laws: up to 100% of the base fare;
  • Emergency or adverse circumstances that may significantly affect the operational capacity of delivery drivers and/or SPX (e.g., storms or floods): up to 300% of the base fare.
The final applicable fee will be displayed to the User before the Service is used, allowing the User to review and decide whether to proceed. The fee shall only be applied after obtaining the Service User's consent.
  • If the parcel cannot be successfully delivered to the Recipient, the Driver will return the parcel to the Sender. In such a case, the Sender shall pay an additional return transportation fee equal to 50% of the original delivery fee.

4. Other Provisions
  • These Terms and Conditions for the Instant Delivery Service form an integral and inseparable part of the SPX Express Terms of Service. By accessing or using the Service, the Customer acknowledges and agrees to be bound by these Terms and Conditions, together with any rules and regulations applicable to the Service, the SPX Terms of Service, the SPX Privacy Policy, and all other applicable terms, conditions, and/or policies of SPX currently in effect and published on the SPX website and/or application (collectively, the "SPX Policies"), all of which are incorporated herein by reference.
  • By choosing to use the Service, the Sender is responsible for notifying the Recipient of these Terms and Conditions and ensuring that the Recipient understands and agrees to these Terms and Conditions, the SPX Privacy Policy, and any other applicable provisions relating to the use of the Service before the Service is used, including any provisions relating to photography or video recording conducted by SPX in connection with the Service (if applicable).
  • To the maximum extent permitted by applicable law, SPX shall not be liable for any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Customer's use of the Service where such claims, costs, injuries, losses, or damages are not attributable to SPX's fault (taking into account the fault of all relevant parties, including the Customer). Such exclusion includes, without limitation, any direct, indirect, incidental, punitive, consequential, or non-contractual damages; fines; actions taken by governmental authorities; claims, costs, injuries, losses, or damages relating to personal injury or death; damage to, loss of, or destruction of property; infringement of publicity or privacy rights; or claims relating to defamation or misrepresentation.
  • SPX shall not be responsible for performing any obligation under these Terms and Conditions where such performance is prevented or delayed by events beyond SPX's reasonable control, including but not limited to acts of God, pandemics or epidemics, governmental actions or restrictions, internet or telecommunications failures, cyberattacks, server outages, third-party platform disruptions, labor disputes, war, or acts of terrorism.
  • SPX reserves the right to amend these Terms and Conditions at any time and shall notify Customers of such amendments through any method deemed appropriate by SPX, including but not limited to publishing the updated version on the SPX website and/or application, sending notifications to the Customer's SPX account, or through other appropriate communication channels. You acknowledge and agree that it is your sole responsibility to review and stay informed of any amendments, revisions, or supplements relating to the Service. Your continued use of the Service following any such amendment, revision, or supplement shall constitute your acknowledgement and acceptance thereof, and such amendments, revisions, or supplements shall be valid and binding upon you.
  • Any matters not expressly provided for in these Terms and Conditions shall be governed by the corresponding provisions of the SPX Terms of Service and the SPX Policies, including but not limited to the Service Quality Standards.
